Artist Rights & Credits

1. Credit me -Omulol- when you use my art or designs and don't claim them as your own work and designs. By default, the artist retains the full copyright of all art and design works. Purchasing a commission grants you "Usage Rights," not legal ownership of the artwork itself, unless a "Copyright Transfer" is explicitly purchased.

2. I don't allow my arts or designs to be used for AI purposes or similar. Please, don't upload them to any AI sites, as this could compromise my artwork. NFT usage is strictly forbidden, too.

3. I have the right to publish my art or designs with a watermark on my social media. For custom design, you can tell me the publication date if you have a schedule that requires it. But if you want to keep them a secret, just you or NDA, the final price will be x1.3 of the total.

4. I have the right to use any of my sketches or ideas/designs that you did not choose or purchase as your own, to adapt in my personal projects, or may offer them for sale or be next adoptable or YCH in the future. It will not be like your design or look like the same thing for sure. (Please, don't use them, my lovely customers)

5. I only sell designs. If you want to use my art for commercial purposes, there will be an additional charge. (ie. Use my arts as the main product, like a novel cover, goods for sale) Must discuss this first, or it may be no additional charge, case by case (ie. If you want to add my original art to show "first original character design concept” in your Artbook, I would really appreciate it. No additional charge for this case)

6. If I find those who BREAK my TOS, especially in copyright/licenses sections, I will give you a warning first. And charge additional costs to suit the rights of work you use in my designs or arts. Or find another solution. If you ignore my warning and don't pay additional for proper use, as it should be. I have the right to reclaim that design or art rights (Without Refund) and add you to my Blacklist.

Designs Ownership & Transfer

1. You will have "Personal use" & "Small commercial purposes" rights for the custom design and adoptable you already purchased as a base until you unlock "Large commercial purposes" rights only. Sometimes, rights will depend on the bid price or SP/AB price. (If it's Adoptable) Please follow the terms and conditions of the announcement one by one.

2. You can trade, resell, or give away the design. After 2 weeks. And must notify me who the new owner is and give my TOS to them. For update Ownership. Check current ownership and rights in 🍳OMULOL🧾 Adopt lists and my toyhou.se account for customers who want to tag me there.

3. For FREE or RAFFLE adoptable/designs from me, always have just "Personal use" right. You can give it as a gift, but you can't resell or trade.

4. You can't resell the design for more than the real price you paid me. If they have commission arts, you can add the price based on the actual price paid. Your own arts and free art or fanart don’t count as value. By the way, you can request other things, not money, to exchange your arts if you and those who are interested can deal. *Please NOTE the value to protect your rights and prevent any drama.

5. No CO-Owners for 1 design. (Or talk about this first, I'm not responsible for any personal issues after that)

6. Please, don't transfer the design to anyone on my Blacklist. (Still don't have) Blacklisting may occur in many cases (ie. Winning adoptable auction but not paying within 2 days without prior notification of your problem, reselling more than the real price paid)

Designs Modify & Editing Designs

1. Feel free to change some parts of the design as you wish, but not too much, so that no one remembers the original design

   • Redraw or commission me or another artist draws new reference.

   • Commission me to edit the design in original art.

   • Edit some parts in the original art by yourself (Discuss with me first, but you can do)

2. Feel free to give the design other haircuts, outfits, and accessories for role play or events. But please, don't use them instead of the main design. (No need to inform me)

3. If the design is just line-art or rough color sketch style, you may color or clean it yourself, but it will be good if you don't adapt the line-art or my signature style much. You should tell me first, or you can commission me to continue is fine too. And must send the original design art to the new owner. (ie. Original sketch design by Omulol, Clean line and Design Color by you)

Others

1. Feel free to tag or share your arts, products, stories, or anything from the design with me! I want to share💖

2. You may use the design as inspiration to design your own character that complements their stories, such as their child or sub-characters for roleplay, but please, not too much, as you are copying my design style or they are twins. And it shouldn’t be for commercial purposes ie Sell as your new adoptable or add in a sample for a custom design commission. (Commission me for a new character in the same theme is fine)

3. If the design is CS (Closed Species), feel free to use their lore & story. However, don't create your own without permission or get MYO from me. If you want to change CS traits, you must confirm with me first. And normally, CS design can use just “Personal use”, but maybe can unlock in some special cases. (Must discuss this first)

4. If you want to design sub-characters, such as their child, from CS design without MYO rights, you can't use CS specific traits. However, you can use some non-specific design, such as color tones, dressing in the same culture, having similar wings but not identical wings, unless you have MYO rights (must discuss first).

⟡ Designs Usage Rights

For Personal use 

• You can create digital or physical (ie, print as a photocard, poster, or screen in your mug) by using the design from me for personal enjoyment, roleplay, or sharing stories with your friends and family. (Non-commercial only) Include my original art, your art, and commissioned art.

For Commercial use (Small commercial)

• You can use my Designs for personal use and Small commercial purposes, like drawing characters new in your Doujinshi, Art books, Goods for sale at original events, as a circle with credit Designs. However, My Art does not allow for sale.

• Normally, the commercial use (Small commercial) right is already included in the custom design or adaptable. Unless otherwise specified, such as "Commercial use (Small commercial) will be available only if a bid of more than X USD" will be noted on the auction or sale post, case by case.

For Commercial use (Large commercial)

• Have an additional charge to unlock, usually, the final cost will be x2 of the total. You can use the design for personal use and up to Large commercial purposes like Animation, Games, Vtuber & YouTube content, Movies, E-book, Webtoon that can be donated and shared to become Viral or earn income throughout life, Other Mass media or Publishing companies with credit design. We'll need to discuss it first. 

• If you are a Vtuber or Webtoon Writer, etc., but just want to purchase and customize your personal character for non-commercial purposes. You can, if you promise that, you will not show that art or design on every Vtuber or Advertising social media. Just keep them as personal OC collections or public on Non-Vtuber or Non-Advertise social media for just roleplay with friends in the community as a normal person or hobby only.​​
