📋 The artist's Rights & Credits  

1. Credit the artist -Omulol- when using the art or designs. By default, the artist retains full copyright of all art and design works. Purchasing a commission or adoptable grants you "Usage Rights" only. Not legal ownership of the artwork itself, unless a "Copyright Transfer" is explicitly purchased. Therefore, you can't claim the artist's art or designs as your own creation, though you are fully recognized as the owner of the art and designs.

2. Always notify the artist if you will use the art or designs for commercial purposes. (ie. Novel cover, Merchandise, Goods, VTuber content, etc.) Usually, the price will be +100% of the total.)

3. Strictly Forbidden: ❌NO AI generation/training and ❌NO NFT usage allowed under any circumstances.❌ Duplicating or tracing the art or designs.

4. Unused sketches and concepts in Custom Design cases that you didn't choose/purchase remain the artist's property. The artist reserves the right to adapt them for personal projects, adoptables, or YCHs in the future.

5. If the artist finds those who BREAK the TOS, especially in the copyright/licenses sections, the artist will give you a warning first. And charge additional costs to suit the rights of the work you use in my designs or art. ie, x4 from the total price. Or find another solution. If you ignore my warning and don't pay additional fees for proper use, as it should be. I have the right to reclaim those design or art rights (Without Refund) and add you to Blacklist.

6. Portfolio & NDA Notice: The artist reserves the right to post watermarked artwork and designs on social media as portfolio samples. You may request to delay publication until a specific date or project release. However, if complete secrecy or an NDA is required, additional fees will apply:

• Delayed Publication 2 years: +50% of the total price (the artist reserves the right to publish after the period ends).

• Indefinite NDA / No Publication Allowed: +200% of the total price.

♻️ Design Ownership & Transfer​  ​​

1. You will have "Personal use" and "Small commercial purposes" rights for the custom design and adoptable you already purchased as a base until you unlock "Large commercial purposes" rights only. But sometimes, rights will depend on the bid price or SP/AB price. (If it's Adoptable) Please follow the terms and conditions of the announcement one by one or in front of the shop.

2. Transfer Cooldown & Process: Trades, resells, gifts, or transfers are allowed 2 weeks after receiving the design. Please notify the artist when ownership changes with the artist's TOS to update current ownership. You can check the current owner at 🍳OMULOL🧾 Adopt lists and my toyhou.se account for customers who want to tag me there.

3. For Free and Raffle Designs:  Will grant just "Personal use" rights only. Reselling or trading is forbidden, but gifting for free is allowed.

4. Resell Price Cap: Resell prices must not exceed the original purchase price plus the actual cost of extra paid commissions. Self-drawn art or free gift art cannot be added to the price. However, non-monetary offers can be combined if agreed upon with the interested party (e.g., adding commissions or adoptables). Please keep transaction records to protect rights and prevent drama.

5. No CO-Owners for 1 design. (Or talk about this first; the artist will not intervene in personal disputes afterward under any circumstances.

6. Blacklist Notice: Don't transfer designs to blacklisted users (currently none). Blacklisting can occur from various cases, such as winning an auction and failing to pay within 2 days without prior notice, or reselling a design above its actual value.

🎨 Designs Edits & Modifications  

1. Edits are allowed, but please keep the original design recognizable by:

   • Redrawing it yourself or commissioning another artist using it as a new reference.

   • Commissioning the original artist to edit the original artwork or draw a new one.

   • Editing the original image yourself (please consult the artist first, but it is allowed). You can't claim full credit for the artwork.

2. Alternate Outfits/Hair: Adding hairstyles, outfits, or extra accessories for roleplay/events is allowed, but shouldn't completely replace the original main design. No need to inform me)

3. Sketches & Linework: For sketch or rough-color adopts, you may color or line them yourself, but please keep the artist's identity. You can show it to the artist or commission the artist to finish it. Always pass down the original unedited image to new owners. (Credit format: Sketch design by Omulol, Lineart & Color by [Your Name]).

🧩 Others  

1. Feel free to tag or share self-drawn art, stories, commissions, or merch with the artist! Happy to retweet/share. 💖

2. Design Inspiration: You may use the design as inspiration for a new character (e.g., children/sub-characters), but they must be distinct by mixing traits from both parents. Don't copy styles/elements directly, and commercial use is strictly forbidden (e.g., selling as adoptables).

3. Closed Species (CS): You may use or omit the abilities written by the artist, but design modifications are prohibited unless permitted or holding a MYO slot. (Trait edits must be confirmed first). CS adopts grant "Personal use" rights only by default. Non-trait elements can be adjusted generally (please discuss first).

4. CS Derived Characters: If designing a sub-character/child/friend from a CS without a MYO slot, using CS Traits directly is strictly prohibited. Only general themes, color palettes, fashion styles, or general elements are allowed (e.g., similar wings/clothing style, but not identical or specific CS traits), unless you hold a MYO slot (must discuss first).

⟡ Client's Usage Rights

🎒 For Personal use  

• Personal Enjoyment: Social media posts, private roleplay, community collections, or sharing with friends and family.

• Gifts & Personal Collectibles: Printing photocards, posters, or personal goods (e.g., printed mugs, keychains, standees) for personal collection or gifting. ❌ Strictly not for resale/commercial gain.

• For freebies and rewards artworks from the artist: Grant "Personal Use" Rights only.

  • Unlock Small Commercial Rights ✧: +60% of the total price.

  • Unlock Large Commercial Rights ✦: +100% of the total price.

👜 For Commercial use (Small commercial)  

• Scope: Covers personal enjoyment and small-scale commercial use for personal physical items, such as redrawing the character in Doujinshi, artbooks, or small personal project merch for original events. Design credit is required, and the original artwork must not be used directly as an element. (Including the original image as a small reference in an artbook to show origin is allowed free of charge with credit: "Original Design by Omulol").

• Restrictions: ❌ Long-term or continuous revenue-generating formats are strictly prohibited, including E-books, Webtoons, novel covers, online song covers, etc.

💼 For Commercial use (Large commercial)  

• Scope: Covers personal use, small ✧, and large-scale ✦ commercial use across both digital and physical media for long-term/continuous monetization, such as:

  • Promotional photocards, posters, business cards, or freebies.

  • Profile pictures, banners, website art, assets, or product graphics on social media (whether small decorative elements or major graphics) for Streamers, VTubers, Content Creators, Authors, Games, Animations, or Companies.

  • Novel covers and interior illustrations (both Physical and E-books).

  • Commercial merchandise for sale (e.g., keychains, standees, art toys).

• VTuber, Author, Creator Notice: If you order under Personal Use rates, you can't publish or display the artwork on monetized accounts/platforms. Allowed only for private accounts/personal collections. For just roleplay with friends in the community as a normal person or hobby is OK.🌟
