⟡ Agreement before Work

Artist Rights & Credits

1. Credit the artist -Omulol- when you use my art or designs and don't claim them as your own work or designs. By default, the artist retains the full copyright of all art and design works. Purchasing a commission grants you "Usage Rights," not legal ownership of the artwork itself, unless a "Copyright Transfer" is explicitly purchased.

2. Always notify me if you will use my art for commercial purposes. (ie. Novel cover, Merchandise, Goods, Vtuber content, etc.) Usually. Price will be x2 of the total.)

3. I don't allow my art or designs to be used for AI purposes or similar. Please, don't upload them to any AI sites, as this could compromise my artwork. NFT usage is strictly forbidden, too.

4. I have the right to publish my art and designs with a watermark on my social media. For custom design, you can tell me the publication date if you have a schedule that requires it. But if you want to keep them as secret, just you and NDA, the final price will be x1.3 of the total.

5. I have the right to use any of my sketches or ideas/designs that you did not choose or purchase as your own, to adapt in her personal projects, or may offer them for sale or be next adoptable or YCH in the future. It will not be like your design or look like the same thing for sure. (Please, don't use them, my lovely customers)

6. The prices listed are just starting prices. Prices may increase depending on details. Please, send a brief for estimate price first. If it includes more than 1 character, the price will be increased based on price scales and details. If you have a budget in mind, we can discuss it.

7. ​If you have a deadline to use this commission. Must tell the artist, and you should give me 1-2 months' advance notice for work like a novel cover. Because it's taken time. Urgent work within 1-5 days may incur a rush charge x1-2 from the total. (Will be considered based on the scale of the work, and I will notify you in advance before accepting your order) Check Work Queues

8. Queues or how fast delivery can change due to factors such as Difficulty, Response speed, Deadlines.

9. You can ask about progress, if it's your queue now, but no update for more than 2 weeks. I'm a webtoon color shading assistant, too. So. I have routine work to do every week. (Normally, I will inform you if I have urgent or busy)

10. I have the right to refuse some requests (i.e., being uncomfortable with Brief, can't do it on time)

11. I usually send finished commissions by using E-mail. If you prefer another method, let me know.

12. If I find those who BREAK my TOS, especially in copyright/licenses sections, I will give you a warning first. And charge additional costs to suit the rights of work you use in my designs or arts. Or find another solution. If you ignore my warning and don't pay additional for proper use, as it should be. I have the right to reclaim that design or art rights (Without Refund) and add you to my Blacklist.

CMS Arts Payment, Ownership & Transfer​

1. Half or Full payment before START only. Or else I will tell you, depending on the case. (ie. must send rough pose sketch to check the brief before paying)

2. If you cancel the work order, you will receive a refund based on the progress. Full refund if not started, 50% If go half, no refund if near to finish or already finished. I usually don't charge a booking fee, but if you book and cancel more than 2 times, you will be blacklisted. Don't book for fun, please. It affects my work plans. We can discuss rescheduling the appointment or change Payment date.

3. For FREE or RAFFLE adoptable/designs from me, always have just "Personal use" right. You can give it as a gift, but you can't resell or trade it.

4. Can Trade, Re-sell not more than the purchase price, give away your commission art as you wish. Such as attaching them with adoptable. Please notify me when the arts change ownership. Check current ownership and rights in 🍳OMULOL🏵️Honor Label. I will update when I have free time.

CMS Arts Works Modify & Edit

1. You can modify the work in any case, but I will not be responsible for any consequences after that. Should notify me first. If you modify the work, always keep the original image. Give the original to the new owner, and you can't claim full copyright of the modified work.

2. If commission arts from me are just line-art or rough sketch commission arts, you may color them or clean them by yourself, but it will be good if you don't adapt the line-art or my signature style much. You can show it to me first, or commission me to continue is fine. ie, for Credit > Original line-art by Omulol, Color by you

Others

1. Feel free to tag or share your products that use Commission Arts with me! I want to share💖

2. If you would like me to design characters or props, etc., in your commission art all at once. Or no Clear Character References. The artist must draw and add a design to see the character's appearance. Please, read the "Design TOS" topic too. And there will be a price increase for the design, depending on your choices.

⟡ CMS Arts Usage Rights

For Personal use 

• You can create digital or physical (ie, print as a photocard, poster, or screen in your mug) by using your commissioned art from me for personal enjoyment, roleplay, or sharing stories with your friends and family. (Non-commercial only)

For Commercial use

• Have an additional charge to unlock. Usually, the final price will be x2 of the total. You can use your commission art from me for personal use and up to Small & Large commercial purposes like add in your Doujinshi, Art books, Goods for sale in Original events as Circle, Animation, Games, Vtuber & YouTube content, Movies, E-book, Webtoon that can be donated and shared to become Viral or Earn income throughout life, Other Mass media or Publishing companies with Credit. We'll need to discuss it first.

• Beware, always check your characters and designs rights before order commission art for commercial purposes, if they are adoptables from other artists or me. If you don't have commercial rights to those designs. You still can't use my commission arts in commercial purposes.

• Conversely, you still can't use your commissioned art for commercial purposes if you commission me for personal use rights, even if the design has commercial rights to use the design.

• If you are a Vtuber or Webtoon writer, etc., but want to commission your Character Art in a non-commercial way. It can, if you will not use or show that art or design on every your Vtuber social platforms. Just keep it as a personal collection, or Roleplay with friends in a community, as a normal person, or roleplay a non-profit individual's account is fine. It will be personal.
