⟡ Agreement before Work

📋 The artist's Rights & Credits  

1. Credit the artist -Omulol- when using the art or designs. By default, the artist retains full copyright of all art and design works. Purchasing a commission or adoptable grants you "Usage Rights" only. Not legal ownership of the artwork itself, unless a "Copyright Transfer" is explicitly purchased. Therefore, you can't claim the artist's art or designs as your own creation, though you are fully recognized as the owner of the art and designs. (For clients' original characters, the character copyright naturally remains with the client.)🙏✨

2. Always notify the artist if you will use the art or designs for commercial purposes. (ie. Novel cover, Merchandise, Goods, VTuber content, etc.) Usually, the price will be +100% of the total.)

3. Strictly Forbidden: ❌NO AI generation/training and ❌NO NFT usage allowed under any circumstances.❌ Duplicating or tracing the art or designs.

4. Unused sketches and concepts that you didn't choose/purchase remain the artist's property. The artist reserves the right to adapt them for personal projects, adoptables, or YCHs in the future.

5. If the artist finds those who BREAK the TOS, especially in the copyright/licenses sections, the artist will give you a warning first. And charge additional costs to suit the rights of the work you use in my designs or art. ie, x4 from the total price. Or find another solution. If you ignore my warning and don't pay additional fees for proper use, as it should be. I have the right to reclaim those design or art rights (Without Refund) and add you to Blacklist.

6. Portfolio & NDA Notice: The artist reserves the right to post watermarked artwork and designs on social media as portfolio samples. You may request to delay publication until a specific date or project release. However, if complete secrecy or an NDA is required, additional fees will apply:

• Delayed Publication 2 years: +50% of the total price (the artist reserves the right to publish after the period ends).

• Indefinite NDA / No Publication Allowed: +200% of the total price.

 

⏳ Pricing & Process  

1. Listed prices are starting prices: Rates may increase based on complexity, details, or extra characters. Please send a brief for an exact quote. If you have a budget in mind, we can discuss it.

2. Half or Full payment before START only. Otherwise, I will tell you, depending on the case. (ie. must send rough pose sketch to check the brief before paying)

3. Deadlines & Rush Fees: Please state your deadline upfront. Large-scale work (e.g., novel covers) requires a 1-2 month advance notice. For rush work (1-5 days), the price will be +50-150% of the total. (Will be considered based on the scale of the work, and I will notify you in advance before accepting your order) 

4. Queues or how fast delivery can change depend on factors such as Difficulty, Response speed, and deadline. I'm a webtoon color shading assistant, too. So. I have routine work to do every week.

5. WIP or Updates: You are welcome to ask for progress if it is in your queue and you haven't received an update for over 2 weeks. Normally, I will inform you if I have a problem or I'm busy. Check Work Queues here.

6. The artist has the right to refuse some requests (i.e., being uncomfortable with the brief, can't do it on time)

7. Commission or adopt are delivered via Email, Google Drive, and VGEN. If you prefer another method, let me know.

8. Cancellation & Refunds: You will receive the WIP/sketch file corresponding to the current progress level

• 100% refund if work has not started. 

• 20-50% refund if work is in progress.

• No refund if the work is nearly finished or completed.

• Canceling orders more than twice without a valid reason will result in blacklisting.

♻️ CMS artworks Payment, Ownership & Transfer​  ​​

1. For Free or Raffle Rewards: always grant "Personal Use" Rights only. Gifting is allowed. But reselling or trading is strictly prohibited.❌

2. Reselling & Trading: You may trade, gift, or resell your commissioned art or adoptables under the same TOS from the artist. Resell prices must not exceed the original purchase price. You may freely gift, offer as prizes, or transfer your commissioned art along with its character design/adoptable as you wish. Please notify the artist of any ownership changes to update the tracker, and ensure the new owner receives the TOS. Check current ownership and rights in 🍳OMULOL🏵️Honor Label. I will update when I have free time.

🎨 CMS artworks Edits & Modifications  

1. You can modify the work in any case, but the artist will not be responsible for any consequences after the edit. Should notify the artist first. If you modify the work, always keep the original image. Give the original to the new owner, and you still can't claim full copyright of the modified work.

2. For sketch or line-art commissions, you are welcome to color or clean them up yourself. It will be great if you don't adapt the line-art or change the artist's signature much. You can show it to the artist first, or commission the artist to continue it is fine. ie, for Credit > Lineart by Omulol / Color by [Your Name]

🧩 Others  

1. Feel free to tag or share your products that use Commission Arts with me! I want to share💖

2. If you would like me to design characters or props, etc., in your commission art all at once. Or no Clear Character References. The artist must draw and add a design to see the character's appearance. Please, read the "Design TOS" on the "Atelier" page too. And there will be a price increase for the design, depending on your choices.

⟡ Client's Usage Rights

🎒 For Personal use  

• Personal Enjoyment: Social media posts, private roleplay, community collections, or sharing with friends and family.

• Gifts & Personal Collectibles: Printing photocards, posters, or personal goods (e.g., printed mugs, keychains, standees) for personal collection or gifting. ❌ Strictly not for resale/commercial gain.

• For freebies and rewards artworks from the artist: Grant "Personal Use" Rights only.​

💼 For Commercial use  

• Additional Fee Applies: Usually +100% of the total price to unlock both small ✧ + large ✦ scale commercial rights, monetization, and earnings across digital and physical media. Proper design credit is required. Examples include:

  • Promotional photocards, posters, business cards, or freebies.

  • Profile pictures, banners, website art, assets, or product graphics on social media (whether small decorative elements or major graphics) for Streamers, VTubers, Content Creators, Authors, Games, Animations, or Companies.

  • Novel covers and illustrations (both Physical and E-books).

  • Commercial merchandise for sale (e.g., keychains, standees, art toys).

• Check Design Rights: Please verify your character design rights before ordering commercial art. If the design itself lacks commercial rights, the commissioned artwork cannot be used commercially.

• Ordering under Personal Use rates prohibits any commercial usage, even if the character design holds commercial rights.

• VTuber, Author, Creator Notice: If you order under Personal Use rates, you can't publish or display the artwork on monetized accounts/platforms. Allowed only for private accounts/personal collections. For just roleplay with friends in the community as a normal person or hobby is OK.🌟
